Terms of Service

We strive to maintain 99.5% uptime but do not guarantee uninterrupted availability. The Service may be unavailable due to scheduled maintenance, emergency downtime, force majeure events, or circumstances beyond our control. We will provide advance notice of planned maintenance where reasonably practicable.

Certain features may be released in beta or preview status. Beta features are provided "as-is" without warranty and may be discontinued, significantly changed, or transitioned to paid tiers at any time without notice.

The Service integrates with third-party providers including Google (Gemini AI), Stripe (payments), Supabase (data storage and authentication), and Vercel (hosting). Your use of these integrations is also subject to their respective terms and privacy policies. We are not liable for failures, changes, or data handling practices of these third parties.

We offer two account types:

• Anonymous Account: You may use the Service without registration for up to 2 complimentary design generations. Anonymous sessions are linked to your device and browser; design history may be lost if you clear cookies or change devices.
• Registered Account: Creating an account via email/password or Google OAuth enables access to design history, purchased credits, subscription benefits, and account settings. Account creation requires a valid email address.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account, whether authorized or not.
• Immediately notifying us at legal@kasaro.ai of any unauthorized access or security breach.
• Not sharing your account with third parties or using another person's account.

We implement industry-standard security measures including encrypted storage, TLS in transit, and JWT-based authentication. However, no system is completely secure and we cannot guarantee absolute security.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Providing false information may result in immediate account termination.

Each individual may maintain only one registered account. Creating multiple accounts to circumvent credit limits, exploit free trials, or abuse promotional offers is prohibited and may result in termination of all associated accounts and forfeiture of any credits.

New users (including anonymous users) receive 2 complimentary credits upon first access. These credits are non-transferable and non-refundable. We reserve the right to modify the number of complimentary credits at any time.

Additional credits may be purchased as one-time Credit Packs (currently 50 credits for $10). Purchased credits:

• Are added to your account balance immediately upon confirmed payment.
• Never expire regardless of account activity or subscription status.
• May be stacked with subscription credits.
• Are non-transferable between accounts.
• Are not redeemable for cash.

Active subscribers receive monthly credit grants (125 credits/month for Pro; 500 credits/month for Expert). Subscription credits:

• Roll over month-to-month and do not expire while your subscription remains active.
• Are forfeited upon subscription cancellation or account termination — unused subscription credits are non-refundable.
• Are separate from and stack with purchased Credit Pack credits.

Credits are deducted upon successful design generation. We reserve the right to adjust credit costs for specific features (e.g., premium styles, high-resolution exports) with reasonable advance notice. Failed generations due to service errors will not consume credits.

Credits have no monetary value and cannot be sold, transferred, gifted, or exchanged for cash or other goods/services. Credits are a limited license to use certain features of the Service.

We currently offer the following paid subscription tiers (pricing subject to change with notice):

• Pro Plan: $19/month — 125 credits per month (rollover)
• Expert Plan: $49/month — 500 credits per month (rollover)

Subscriptions require a registered account and a valid payment method. Subscriptions cannot be purchased with an anonymous session.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time through your account Settings page or via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You will retain access to subscription benefits (including existing credits) until the end of the paid period. We do not offer prorated refunds for mid-period cancellations.

All payments are processed by Stripe, Inc. We do not store full payment card details on our servers. By making a purchase, you agree to Stripe's Terms of Service. Payments are non-refundable except as described in our Refund Policy below.

Due to the nature of digital goods and instant credit delivery, all sales are generally final. However, we will issue refunds in the following circumstances:

• You were charged due to a verified billing error on our part.
• Credits were not delivered within 24 hours of a confirmed payment.
• You were charged for a subscription renewal after timely cancellation.

To request a refund, contact legal@kasaro.ai within 7 days of the charge with your transaction ID and a description of the issue. Approved refunds are processed within 5–10 business days.

We reserve the right to change subscription prices. Existing subscribers will receive at least 30 days' advance notice of price increases via email before the change takes effect. Continued use after the notice period constitutes acceptance of the new pricing.

Prices listed are exclusive of applicable taxes. You are responsible for any sales tax, VAT, GST, or other applicable taxes levied by your jurisdiction. We may collect and remit taxes where required by law.

The Service uses Google Gemini AI to generate design visualizations ("AI-Generated Content"). You understand and acknowledge that:

• AI-Generated Content is created algorithmically and may be unpredictable, inconsistent, or not match your expectations.
• Design renderings are illustrative visualizations only — they do not constitute architectural plans, engineering specifications, or professional design advice.
• Cost estimates generated by the Service are rough approximations only and may differ significantly from actual contractor quotes.
• AI-Generated Content may occasionally produce outputs that are unexpected, unusual, or do not accurately reflect the input photo.

Subject to these Terms, you are granted a non-exclusive license to use, download, share, and display AI-Generated Content created from your uploads for personal, commercial, or professional purposes (including client presentations, listings, and marketing materials). You may not claim that AI-Generated Content was created by a human designer without disclosure.

AI-Generated Content is not a substitute for professional architectural, structural, electrical, plumbing, or landscaping advice. Before undertaking any renovation or construction project, consult qualified licensed professionals. Kasaro AI expressly disclaims liability for any reliance on AI-Generated Content for actual construction or design decisions.

AI models can make errors, hallucinate design elements, produce outputs that are structurally or physically impossible, or generate content inconsistent with building codes. We do not warrant the accuracy, feasibility, or completeness of any AI output.

We reserve the right to review AI-Generated Content for policy compliance and to withhold or remove outputs that violate our content policies, including outputs that are harmful, deceptive, or otherwise inappropriate.

You are solely responsible for all photographs, images, and other content you upload to the Service ("User Content"). By uploading User Content, you represent and warrant that:

• You own the content or have all necessary rights, licenses, and permissions to upload and use it.
• The content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights.
• The content does not contain personally identifiable information of individuals who have not consented to its use on the Service.
• The content complies with all applicable laws and regulations.
• You have obtained consent from any individuals visibly identifiable in uploaded photographs.

By uploading User Content, you grant Kasaro AI a limited, non-exclusive, worldwide, royalty-free license to:

• Store, process, and transmit your User Content for the sole purpose of providing and improving the Service.
• Generate AI-designed outputs from your User Content using third-party AI models.
• Display your User Content within your account's design history.

We will not use your User Content for advertising, training external AI models, or sharing with third parties except as necessary to provide the Service (e.g., transmitting images to Google Gemini API for processing).

User Content and generated designs are retained in your account until you delete them or close your account. We may retain anonymized or aggregated data for analytics purposes. Upon account deletion, your User Content will be permanently deleted within 30 days.

You may not upload content that:

• Contains nudity, explicit sexual content, or is otherwise pornographic.
• Depicts violence, gore, or harmful activities.
• Contains hate speech, discriminatory content, or content targeting individuals or groups.
• Infringes copyrights, trademarks, or other intellectual property rights.
• Contains malware, viruses, or other harmful code.
• Violates any applicable law or regulation.

The Service, including its software, algorithms, design system, brand assets, marketing content, documentation, and all related intellectual property, is owned by Kasaro AI or its licensors and is protected by copyright, trademark, trade secret, and other laws. These Terms do not transfer any ownership rights to you.

"Kasaro AI," the Kasaro logo, and related marks are trademarks of Kasaro AI. You may not use our trademarks in any way that suggests affiliation, sponsorship, or endorsement without our prior written consent.

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or professional design purposes. This license does not include the right to sublicense, resell, copy, reproduce, or create derivative works from the Service.

If you submit feedback, suggestions, or ideas about the Service, you grant us an irrevocable, perpetual, royalty-free license to use that feedback for any purpose without compensation to you.

You may close your account and stop using the Service at any time through your account Settings page. Closing your account cancels any active subscription effective at the end of the current billing period. Unused subscription credits are forfeited upon account closure and are non-refundable.

We may suspend or terminate your account and access to the Service, with or without notice, if:

• You breach these Terms or our policies.
• We believe your use poses a risk to the Service, other users, or third parties.
• You engage in fraudulent activity or abuse of the credit system.
• We discontinue the Service (with reasonable advance notice).
• Required by law or legal process.

Upon termination for cause, any outstanding credits and subscription access are forfeited without refund. Upon termination for our convenience (e.g., Service shutdown), we will provide a pro-rata refund of any prepaid but unused subscription fees.

Upon termination, your license to use the Service is revoked. Provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive termination.

Before filing any formal claim, you agree to contact us at legal@kasaro.ai and attempt to resolve the dispute informally. We will try to resolve complaints within 30 days of receipt. This informal process is a prerequisite to any formal proceedings.

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and Kasaro AI each waive the right to a jury trial and the right to participate in a class action lawsuit.

The arbitration will be conducted in English. For claims under $10,000, either party may elect to conduct the arbitration solely on the basis of documents submitted.

YOU AND KASARO AI AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Either party may bring an individual claim in small claims court for disputes within the court's jurisdictional limits, provided the claim remains in small claims court and is not removed to another court.

Any claim must be filed within one (1) year after the cause of action arose, or it will be permanently barred.
